Currently, the Thurston County Clerk’s Office does not provide forms or packets for Probate. Whether you need to file for probate is a complicated question and best answered by an attorney. You can research probate information, resources, and free forms online by searching “Washington State Probate”.

Note: Letters Testamentary or Administration are issued per court order in a Probate case.

The initial documents needed for opening a Probate case:

  • Case Cover Sheet
  • Petition
  • Original Will (if there is one)
  • Death Certificate (certified copy)
  • Oath – must be Notarized
  • Order Admitting Will and Issuing Letters Testamentary, OR
  • Order Granting Letters of Administration (if no will)

You may present your case documents and order to the Court daily on the walk-in “Ex Parte Calendar” – see Thurston County Superior Courts website calendar times.
